If by partnership you mean a legal partnership (LLC or LP or otherwise), then that legal entity would need to either dissolve (or deed out your 50% to you) prior to sale before you could sell your own 50%.

Just remember you are also dealing with CFPB and consumer protection laws so in some states you just don’t “throw someone out” it could take you years to foreclose and tens of thousands in legal costs.Then that’s just to foreclose, you still have to evict after that…
