James,See what your lease says regarding the unit not being habitable.  12 hours lack of water is probably a stretch but you can use it as a learning experience for the Tenant.

Also (as Chris mentioned) you can check the noise rating of the different materials.Also, the IRC calls for a minimum ceiling height of 7'6", except in non-habitable basements.

The letter can include 50 pages of disclaimers but there are plenty of CPA's that lost a lot of money and their license by providing quasi-assurance with insufficient basis for doing so even with disclaimers of liability.I know you don't care how many CPA's you harm, but you are dead wrong in criticizing a CPA for being smart enough to deny your ridiculous request.

If they get too needy - make them submit complaints via written notice so that they do not get into the habit of expecting you to drop everything your doing to tend to them on  a moments notice.
