Come to find out it appears the mortgage company that had the lien went out of business and somehow the electronic mortgage system issued a release of lien on the property, making it free and clear of any mortgage debt.

If that's the case, why even bother with earnest money.Around here, binder money is held be agents, and real estate contract earnest money are usually held by sellers attorney in an escrow account and you should contact them immediately not to release funds.

As far as I understand it, the sellers breached the contract when they did not deliver possession on the day of closing.Now the settlement agent (my agent picked them) is telling me she won't release my wire ($10K) until both parties have signed a contract release.What is the point of a contract release signed by the seller if they're the ones who breached the contract?

The lawyer (or real estate agent) can also draft a assignment agreement that releases you from the contract in favour of the new buyer It's a fairly simple and common process and 10 days is more than enough but judging where you are at I'd spend a day and get it done sooner than later
