The requirement of possession under common law quiet title was because of the lack of a legal remedy (at that time, ejectment was legal and quiet title was equitable) if you were in possession, because you could not file ejectment in order to try the title.

What if a partner acts outside of those roles and what are the remedies?

Refinancing can remedy that, but just something else to consider.

But items like knob and tube or old plumbing might be less marketable, it won't affect the value of the house in comparison to the cost to remediate.
