A drive by appraisal I had done has been disputed because  the house is a 2 bed but the comps are for 3 beds.Appraiser said he assumed 3 bed because I didn't tell him how many bedrooms were in the house, I say he should and could have found out himself or asked me instead of assuming.It's 30 days since the appraisal was done.

There is little to dispute here as far as failure to perform on the contract (assuming the contract doesn't give them a longer period of time to finish than you are claiming).
