If the Landlord gave the tenant permission to leave or break the lease early, then I would argue it's terminated and the 21-day clock begins ticking.

I would also argue that a violent felony conviction is a greater threat than someone dealing marijuana or drunk driving.Here's another issue: most Landlords will set a policy of "No felonies within seven years".
