The 10,000 is an absolute loss for leaving the deal versus 40,000 that even if I the seller am owed it trying to collect from the buyer or their representative will be like pulling teeth.Was there a listing broker and buyers broker or just the listing broker here??

For him, most of my work was going out to represent him in his place at meetings he couldn’t fit into his schedule, facilitate relationships with potential donors for grants, and/or stand in his place when something needed to be taken care of with his oversight committee.

Your attorney can hold it or their attorney or title etc.If you can't agree on who holds it I have seen a separate attorney conduct the closing and hold funds that doesn't represent either party.

If you just want to keep the tenant buyer's option fee as your profit and re-write the lease/option you have with the seller now in the tenant buyer's name, then you are out and the pay down does pass to the buyer and I don't think "purchase price is the un-paid balance" represents financing to the tenant buyer.

In the case of a turnkey that has very little maintenance/repairs during the first year or two and no vacancy because it was just rehabbed and rented at the time of purchase seems to represent the best case scenario.
