By foreclosing on the note, it goes to auction so, you may not be the one acquiring it unless you outbid other potential buyers, which means if the bids go beyond total debt, the person being foreclosed gets the surplus.Maybe it's better to purchase the note and offer the borrower a deed in lieu?
