Department of real estate in almost all states is the authority over PMs as they need licensed so complaint to them to start .. then they get the proper criminal folks in the state involved.. thats what I have seen.If its smaller amounts then complaint to the DRE usually will rectify it as the PM does not want to lose their license and their lively hood..

If the second unit is not permitted and you want a conventional loan or FHA or VA they might condition to tear it down.Probably if no permits you need to go hard money and won't be able to refinance conventional until the county planning department shows you pulled permits and met whatever they now want to meet code.There are some exceptional counties with density and high value that grandfather in a conversion done to code in the 1970's called a granny flats.What does the tax bill show as square footage?

@Shanna Pettie I’d call around and ask about DSCR loans they typically require less down.. fair warning, credit unions often have great products in this department but in my experience they don’t close
