He said I could go ahead with serving papers and beginning the process, but if the tenant signs the covid hardship paperwork for NYS I may still need to wait until the covid situation/rent moratorium is over before a judge would allow the tenant to be removed.

They just keep pushing it down the road otherwise.Also as to the first floor, I hope you got a new rental application from them so you know who is there and also signed them to a new lease (even it is month to month) to show the new rent.The person who sold you the building did n't do what they were supposed to.
