To reiterate @Bill S. and again, no lawyer, but this is how we've handled it.If you have a signed lease with the booted tenant, you can't just rent out his place to someone else without regaining possession of the premises.

I believe will still follow thru either way,, I guess my main concern is that if I gave notice to tenants, and buyer takes possession during the 30 day notice period,, and tenant didn't move.. whom would be responsible to follow thru.. the assumption of leases by the buyer would (I think ) make them responsible to do eviction action if tenants fails to vacate..

One count is generally for possession and two count is for possession AND damages.You have 30 days to notify them in writing of your claim against their security deposit.

As per the rules we are supposed to give them a 10 day notice to vacate prior to filing for an order of possession so that the sheriff can then begin the process of eviction.

@Eric C.Last one was May 4th this year I took possession of a 3 up 2 down triple detached legally suited property which was needing renovations but not really any repairs.

When things go south, your top priority is getting possession back so you can move on and get back to cash flowing.Having a section 8 voucher may make it less likely that things will go south, but housing authorities won't help you get her out.

Because they showed up to court, the judge didn't award immediate possession, but the tenant got 10 days before possession was awarded and the landlord could file for sheriff's eviction.Notably, a few people asked the judge if they could have 30 days or until the end of the month.

Not to steal your thread.. however I think you will get a kick out of this.one of the ones I bought his year in North Portland.... the rumor from neighbors was there was a car in the basement.. well there was no driveway or any way to get into the basement from the exterior so I did not believe it.. we finally get possession after 2 years ( had to litigate it)  and lo and behold my trash out guys says there is indeed a car sitting in the basement.. so apparently this hoarder extreme took it down there piece by piece and put it back together.
