In places with electric baseboard heat, we provide programmable thermostats (some of which we can monitor remotely - rooms) and control physical access to thermostats in common areas.On the lease side of things, we make it clear that if utilities are abused (which normally means heat), we will provide them with one warning prior to assessing a surcharge.Similarly, in our apartment buildings with central heating plants, if we see windows open during heating season, we provide a warning and, on subsequent offences, assess a heating surcharge to the tenant.  

There are several provisions that must be incorporated into a contract in order to make it valid and enforceable - and even then it will still be open to argument and interpretation based on a myriad of other factors. 

I'm an out of state investor and thus was unable to physically get out to the building myself, but had a trusted professional building inspector perform an inspection. 

That way all the hard stuff is done for you and your only job is conducting due diligence, so your workload is minimized and you don't need to be physically present at the property.
