I really don't want to rent it out, everything is fresh and brand new, also to hold it that long I think would cost me what I would be saving in taxes.

If I have cash stored elsewhere and continue to make timely payments on the HELOC, the lender has a performing loan - I'm assuming most lenders wouldn't shoot themselves in the foot by calling in a performing loan.
