Here's the law from Mass General Laws, Title XVI, Chap. 112, Section 87PP:''Real estate broker'', hereinafter referred to as broker, any person who for another person and for a fee, commission or other valuable consideration, or with the intention or in the expectation or upon the promise of receiving or collecting a fee, commission or other valuable consideration, does any of the following: sells, exchanges, purchases, rents or leases, or negotiates, or offers, attempts or agrees to negotiate the sale, exchange, purchase, rental or leasing of any real estate, or lists or offers, attempts or agrees to list any real estate, or buys or offers to buy, sells or offers to sell or otherwise deals in options on real estate, or advertises or holds himself out as engaged in the business of selling, exchanging, purchasing, renting or leasing real estate, or assists or directs in the procuring of prospects or the negotiation or completion of any agreement or transaction which results or is intended to result in the sale, exchange, purchase, leasing or renting of any real estate.In addition to the hazards of brokering real estate without a license, wholesalers can be sued for "fraud in the inducement" if you sign an offer to purchase without both the intent and the ability to close on the sale.The only legal way to wholesale in MA is to close on the property and then re-sell it.

@Joe Vastola I know this goes against the wholesaler's creed of "hooray for me and sellers fend for themselves", but if you're entering into contracts that you cannot fulfill, you can buy yourself a boatload of trouble - not to mention the duress you put the seller under.Think lawsuits for: specific performance, fraud in the inducement and maybe even consequential damages from the seller who made other plans that depended on you to fulfill the contract terms.Don't forget that if you start marketing properties that you don't own, there's always the possibility of facing charges of brokering real estate without a license.

Then again, the Statute of Frauds requires that real estate contracts be in writing.That said, the wholesaler could still be sued for "fraud in the inducement", meaning that he entered into a contract without both the intent and the ability to perform to it.I'm not sure how a realtor got involved, but you can expect that he'll be looking for a commission.

I believe that you'll find that selling contracts is still interpreted as marketing a property that you do not own - which will require a real estate license.Also, if you put a property under contract without both the intent and ability to close on it, you could face a lawsuit for "fraud in the inducement", because you convinced a seller to sign a contract that you had no intention to see through to the completion promised.The LEGAL way to wholesale is to close on the property first, then market and sell it.
