Foreclosure sales and procedures and rules affecting such differ in each state - so it is impossible to answer any of your questions without first knowing what state the property is in and knowing the laws concerning such of that particular state.In general, a junior lien holder has the right to payoff any lien in a senior position at which time the junior lien moves up in priority.
