Considering the 4-month old system was still under warranty, I had the tech come out and look at it, simply to discover that the tenants did not change the air filter and that was causing the system to not run as cool as it should.

If there is something missing in the application or if he finds a discrepancy in what the application says and the information he discovers he makes the prospective tenant aware of the issue and puts the ball in their court to try to correct the discrepancy.

It could be interpreted, and there has been case law, the an option constitutes equitable interest assignment and therefore violates Due on Sale Clause it the lien holder discovers.
