Not sure how valid it is as I'm not a lawyer and hasn't been tested yet, but in my lease in my non-smoking clause, fireplace clause and elsewhere, I state specifically that determination of existence of odor is at Landlord's discretion, and I have specific language about air duct cleaning, carpet cleaning, professional household cleaning of walls, cabinets, etc., at Tenant's expense if necessary to eliminate odors.

They point out that new homes typically come with builder warranties and cost less to maintain, at least in the initial years of ownership.Also, the cost of building a new home is relatively low these days if lots were purchased on the cheap.

I then go the same day to my title company and get the title work started and typically on day 30 I get a call from the title company telling me that my title work is done and I can now sell the property and provide warranty deed.This is the situation I am in.
