It is just that a lot of people lose from individual stocks.

From what I've seen, I don't think it's worth backing out and losing your $10,000 deposit.

I have kids and they need to be enrolled in their new school, and will have to secure the new place by X date or I lose it. 

Will we lose the primary residence capital gains tax advantage if we transfer the deed into an LLC?

When you lose that lawsuit, the court will issue a judgment against each and every partner for the full amount of the damages (which can also include court costs and post-judgment interest and depending on the terms of your loan agreement, maybe even the lender's attorney's fees for the suit).
