I feel her winning possession of the property and keeping the 3 months of withheld rent(and additional months after while remodeling the other unit) was very unfair so I'm paranoid now and want to consider every angle i can.

We often require prospects to apply before they can see a property - yes, we lose some qualified prospects, but we win bigger via weeding out unqualified time-wasters.We charge a $25 app fee which only covers our hard costs for screening report, so no refund issues.Can't see how the 2nd fee would go over well, unless you are in a super hot market.
