@Benjamin Amaral no, it's an act of God, but if you don't rectify the issue by removing that tree then that would be a diffrent story, do right by eliminating the thing causing the damage so your tenants can rest assure it will not continue to cause them damage or harm.

They are out of compliance with the lease, they have 10 days to fix it or vacate, you intend to end the contract if they do not.
