In rare cases where there is a dispute between buyer and seller in regard to who is owed the earnest money, it can go through mediation, or escalate to court if it’s above $10,000.I know it’s frustrating to have to re-list your house, but I’m confident you will have another buyer that will get you to closing within a month or two.Fighting in court for an extended period of time for a hope, and no guarantee of more money, does not seem worth it to me.

This has been a wildly frustrating ordeal, especially given that I went through all the steps to apply for the easement, per the lender's requirement, only for them to deny the loan. 

Brian,We completely understand your frustrations in the permitting process with the ample amount of delays the city has encountered.

We lived in a town just outside Detroit a few years ago and the permitting process got so frustrating that we sold our primary residence and other properties and moved 5 miles outside of town and found the county process way easier and less restrictive in terms of what they wanted and what they actually knew if they showed up. 

The biggest frustration comes from it taking more time, especially when it's you first attempt.

I am very frustrated with current CPA with regard on other obvious errors that could making me pay thousands more than I should.

I wouldn't let their nonsense frustrate me too much and I would be professional and fair but more terse with them than an average tenant.Dealing with difficult people is unfortunately part of being a landlord.
