I have a tenant who moved in June 2018, signed a 1 year lease, and submitted a deposit.This weekend I learnt that they cannot make the August rent payment and we have agreed to part ways.Question: Being that they broke the lease agreement, do they lose out on the deposit?

My understanding is that the roomate never signed a sublet lease with the tenant or a normal lease with the owner.

(side note-she requested her pet deposit back and since the animal had done no damage, I returned it, with HIS permission)HE requests her off the lease but wouldn't sign a new lease; issue subsidesHE requests to sublease the unit-I do not sublease; issue subsidesHE states he is moving in with his new girlfriend and wants to break the lease.

The only concession I got from him was (1) He and all crew members will sign a hold harmless release of waiver of liability form in case any of them got injured, and (2) cash means I will write him a check in his personal name.So I do have cancelled checks to individual names, even on the check I wrote a reference "debris clean up @ address".
