You need to involve your lawyer in this situation and have him review your state landlord tenant regulations on this situation.Based on what I know if he was not renting from his parents, simply one of the family living in the home, then he is not their tenant and does not become your tenant.

If the notice to enter indicated the intent was to paint, and assuming the state regulations permit landlords to do work with notice, then the judge would say OK, good, thanks.

See http://www.consumerfinance.gov/regulations/ability...As I understand it, if there is a financing arrangement, such as a wrap, contract for deed, lease option with rent credits, etc, the penalty for sellers if the Owner Occupant financed buyer gets an attorney and sues the seller and gets awarded up to 36 payments plus court costs plus attorney's fees plus down payment.
