It points directly to conflicts of interest and non-aligned incentives that owners and PM's always potentially have (particularly those PMs running in-house maintenance operations from which they extract profit directly tied to the amount of usage).You did qualify that by saying they're doing the same with their own units, and I can relate to the idea of trying to push your building into a higher rental tier, which will likely involve removing your lower-tier tenants who likely wouldn't qualify at the higher tier.

The IRA will be considered to be immediately distributed in full and your father will owe all taxes and penalties associated with the transaction.There is no way around this.Even if he were to make this investment with a non-disqualified person the IRA would still owe taxes if this was an active business like fix and flipping or wholesaling.

This is exactly what I said in my post above last night, which was what was previously pointed out to me by my broker.So, in general, it sounds like the law frowns upon brokers creating any non-simple contracts, but will tolerate it if they make the contract subject to the review of the attorneys for all parties.Based on that, I'd suggest that it's more legal for brokers to do this than Dale believed and less legal for brokers to do this than I believed.So, we're both wrong...or right...or somewhere in the middle...At least as far as New York is concerned, and it appears that other states have also adopted that ruling from what I could tell.

In the meantime she filed a tenant answer with the court basically saying she needs more time for the rent, I have kids, bla bla bla...She's not even being evicted for non-payment, she's not under a lease and we want to rent the property to someone else, so to me that shouldn't even apply but the court now sets a hearing date a month from now!
