The entire amount of unrecaptured depreciation is taxed as a lump sum in the year of sale even though your sale profit will be received in future installments.As an alternative, you may want to consider a 1031 into a new rental property in the location where you eventually want to establish your principle residence.

I could on for an hour about why not to take section 8 but my guess is that lesson will come to you soon enough.Treat it like a business, don't take sh*t from any tenant, don't deviate from established policy (but you need to have established policies first which I would bet you do not have).As to your question you can spell out your policies regarding lots of things in a tenant handbook, never in a lease.

Did you establish a tenant file for him which includes a copy of his driver's license (or other photo ID) and a copy of his personal check (that will show his bank account information) and information about his employment situation (for possible garnishment)?

Depending on the disability, someone could claim you denied because you did not want to pay for "reasonable" updates to help the resident live there.If your scoring criteria automatically denied those currently under a collections case, you'd again have no potential issues whatsoever with case #1.Once you establish your overall scoring criteria, then it's just a numbers game.
