If you want it done right...engage an attorney and a tax CPA that will have the deep conversation with you, including the intent and the goals of each party.

We see these often in foreclosure where we ask the court in a declaratory judgment action to hold that the leases aren't valid and to strike the agreement between the parties because it's not good faith and fair dealing.There's likely precedent to that effect in your state, but it's so much harder to cure a bad lease than to not buy the property with a bad lease on it.

In this case I would have the tenant remaining sign a new lease with the remaining term of the original (unless they wanted a different length)And then I would write a separate half page document cancelling the previous lease and have everyone one sign it.This scenario is why I like all parties to qualify financially if there's unrelated people on a lease.
