And of course this really all boils down to intent and your pattern of business.If you routinely act as a broker IE have a flashy website.. advertise on craigslist JUST LIKE  A RE broker with pictures and descriptions. appoitnments to show homes to prospective buyers . your going to have a hard time with this being a simple sale of an equitable interest theory..

Based solely on your descriptions, NO tenant of mine would be charged for those issues.Odds are, you will need to file a suit in small claims court, which is typically very inexpensive (under $50), and you are NOT required to have an attorney.
