That’s absolutely ridiculous. can you get around that clause by “non-renewing” with the current tenant that wishes to stay and then having him “re-apply” with the new property management company once they take control?

All monies received are applied to fees first then rent.

Do you get the same interest rates and payments after a year and you apply for a new FHA loan?

You have a $100k loan.You apply for and receive a $150k loan.First $100k is used to pay off the existing loan.The change, $50k, is deposited tax free into your checking account and you can do with it what you wish.Make sense? 

The loan needs to be owned by Fannie Mae for their rules to apply. 

If Buyer chooses to seek financing, Buyer may do so at Buyer’s sole risk and expense by submitting a mortgage application to a mortgage lender or mortgage broker within five business days from the date of this Agreement, but the failure to apply for or secure financing in the amount or time or terms desired by Buyer shall not excuse Buyer from timely performance of all obligations under this Agreement.

I'm not familiar with state laws in MN, but as far as I'm aware it is not a HOA Super Lien state so my aforementioned statement most likely applies.
