We are going through a contentious divorce and I would like to buy her out, but apparently thats not very easy.If we sell the properties our gross earnings will be about 300k, while our net earnings will be around 150k, due to capital gains, depreciation taxes and realtor fees.My lawyer, who is not experienced in real estate investing, says I have to buy her out based on gross earnings, so I'd owe her 150k.

That they work to execute on your decisions, and equip you to be best empowered to make the best decisions, but never NEVER will it be 100% hand's off "no managing the managers".

Either they're a good tenant or they aren't.I don't know if this qualifies as bad advice because I think it would greatly depend on your local/state laws, but if you're planning on doing this you might want to consult with a lawyer first, too.

FYI the interest of doing it in trusts would be to avoid probate and any inheritance taxes, but again, I'm just doing research and am not a lawyer so just trying to get more info so I know which direction to go and what to ask when I get things set up
