If I am in default and they have given me notice saying pay up or we are going to seek all remedies available to collect our money, then they can seek buyers for the note without my consent or even my knowledge, at that point I brought this upon myself!

I am not interested in anything that "pushes legality" if it is not completely straight and open and legal I will not do it.The California Civil Code states:[i](e) Whenever any equity purchaser purports to hold title as a result of any transaction in which the equity seller grants the residence in foreclosure by any instrument which purports to be an absolute conveyance and reserves or is given by the equity purchaser an option to repurchase such residence, the equity purchaser shall not cause any encumbrance or encumbrances to be placed on such property or grant any interest in such property to any other person without the written consent of the equity seller.

Changing this without their consent would not affect their binding lease contract with you personally, which would defeat the purpose of transferring to an LLC (asset protection).

Then there is a separate consent to a background check form that is 1 page.I compared the questions to my state's apartment association application that is used by just about every large apartment complex and it is briefer and easier to fill out and has much, much less legalese thrown in.I think the lack of getting a commitment before they leave is legitimate, but as a previous renter, I've never been coerced to complete an application onsite before.

Dory makes good points, a later poster, sorry can't name him, suggested doing this strategy with consent of the lender and I agree it's best to do so and consent can be construed by notice, Bryan was correct in structuring it as a wrap or a second obligation (the best way IMO) doing deals through a trust can smell shady, but placing a property in a trust for estate planning reasons is specifically addressed as an exception to the due on sale, so after your estate palnning is accomplished I suppose you could sell for liquidity, not real shady, and the sub-2 out of all installment transaction will usually or most likely be the most favored method by an judge looking to equity in the transaction.
