The lease applies to ALL, regardless of handicap (ex. if can't physically do the cleaning, they can pay for or get assistance to have someone come in & clean).Best of Luck!

You can't evict them because even if the case goes to court, the judge won't allow you to evict a handicapped, senior couple, who happen to be victims of a mortgage fraud.

For someone in a wheelchair, this might mean needing a handicapped unit, or someone with claustrophobia to be able to live on the first floor to avoid the elevator.But, you don't get to keep the family rottie just because you got in some landlord's face and waved around a service dog vest and certificate and letter he bought off Ebay.And remember, it's all about "reasonable" accommodation.

By selecting the most qualified candidate applicant, based on your screening qualifications, and by doing so eliminate a applicant with any type of handicap animal you are not discriminating.If, based on the flexibility of the guidelines for screening, a landlord can not find a way to exclude any and all applicants they wish, without openly discriminating, they have not thoroughly screened.If you do your job correctly you should have no fear of having broken any rules.

You just have to make sure you're not approving/declining an applicant based on race, color, sex, religion, creed, national or ethnic origin, age, familial or marital status, handicap or disability or sexual orientation.
