@Chris T.Yes, discuss the matter with your custodian.In all likelihood, they will need to have the money returned, and a new set of investment paperwork submitted for any future transaction.

I was thinking either monthly payments through rental cashflow or at time of sale in the future?

Will the future buyer's lender have any issue with the chain of title? 

I am new with the area but I read about the Hopkins plan it sounds a like a good investment for the future. the property is fully renovated and with tenant with good rental cash flow.

What other ramifications could I see in the near future other then a potential due on sale clause?

Fortunately the carpet is new, so barring any disaster, I should be covered by tenant's deposit for any damages that occur in the future.  

I looked up both of your recommendations and I will use them in the future.
