Real Estate agents are not needed to buy and sell property, there is no laws requiring the use of an agent (To answer you example in italics, yes I would contact the defendants lawyer to get information if my lawyer wasn't doing their job also, also because of disclosure of information in a legal case I wouldn't need to contact the other lawyer.) 

My lawyers have advised against the very things other investors are doing successfully.

As long as the appropriate docs are in place with the lender (so you're fully aware of all the terms/conditions of the loan) and you have a verified exit strategy (refinance or sell at a price that would cover the debt), I would go with that option. 

And get a securities lawyer to make it legal.
