These repairs were done without city permits or approvals, without using licensed contractors, and consisted of the slab foundations being cut, removal of dirt, and filling it back in without compaction.I guess I can't blame him for attempting to pull one over on me, after all, I am a stupid investor from CA with money pouring out of my ears just wanting to place it anywhere I can!!

You'll need to show that the previous Knew the problem was not fixed, and can't reasonably believe he "fixed" it by cutting/grinding out roots.

As well, there have been any number of syndication deals reviewed on BP that include a syndication 'cut' (e.g. 100% of the funds needed get less then 100% of the project with the syndication sponsor getting the balance).

I think he just cut corners, didn't install proper weed barrier do didn't make it 3" compacted so stated in error contract.I didn't ask for references (my mistake) and I believe the license number was on the contract, I will check tonight.
