Just facts - I'm demanding my money and I'm filing a small claims action today.The thing is, there is zero consequences for doing this, other than losing the filing fees. 

If none of this works, then he is a hard headed guy, who doesn't care about the consequences. 

Since the OP is in Texas, it is really of little consequence as to whether legal fees can be added or not if the judgement cannot be collected.

My worst fear is that if the law does not allow me to evict this guy I may be forced to self evict regardless of the consequences.

Instead I am going to offer the only solution that makes a lick of sense to me today, to help nip this thing in the bud for tomorrow, which is that the impact of offering a months grace is a good thing that will have good consequences.

You may never collect, but you can at least give them a consequence, and it won't cost you much in the fees to sue in small claims court, and with the judgment on their credit, at least you can warn future landlords/lenders.

Treating people like they're smart enough to understand the consequences of bad behavior, and that they should also know that you respect them, but you're also not stupid.
