If they let you go on leaving your wheelie bins out for 3 days, leaving construction debris on your lot, letting your grass grow or parking unregistered cars (all violations in our HOA) and then I come along and add a garage to my property that encroaches on the property line (but still within city code-this is Colorado now) and the HOA tries to stop me they may well be SOL.

They have access to raw data on your neighborhood and can show you the standard DOM (days on market) and the list to sale price (how much are homes listed for versus what price do they actually sell for?).

If the old Landlord keeps it, I would consider that theft and I think a court of law would agree.If it's not too late, have the tenant put a "stop payment" on the check before it's cashed.If it's too late, notify the old Landlord - in writing - that the money rightfully belongs to you for payment of rent and demand return within XX days or you will file a claim in court.
