Some residents move out on their own without having to go to court. 

Cop here: Local laws (how the court will handle it) will determine if she needs to evict him or can just tell him not to be there.

The unit is in a condo-tel type resort with all the required amenities (3 swimming pools, hot tub, tennis courts etc) and is about 10 min walk (3/4 mile) from the ocean.

Evictions here in town used to take 30 days and it was all done, but now it is taking 60 days or so just to get a court date, and then we have to go through the eviction process. 

As to the divorce {{sorry}}  You need a decree that is court ordered saying what you owe.

Whether this would hold up in court if challenged for an ESA I do not know. 

The court could serve her roommate which would be enough to force her out of the apartment.

And it's a defense in court if it ever went to court.

You could certainly try small claims court to collect on service calls with no problems found.
