After executing a contract with a seller and passing the inspection period the title search turned up a second mortgage that puts the seller under water on the property by something in the neighborhood of $50k.The contract was in Florida done AS-IS.Do I have any ability to force the sale to be completed and acquire a clean title?

This was a reply to my email stating that after a discussion with an attorney, he advised me to offer an option to close on the house by Feb 1st, 2016 or received his down payment back minus legal fees, cleaning and repairs costs.

If you are getting non-recourse and putting 25% down the deal has to underwrite cleanly and be pristine.

The rooter guy says they can be cleaned with the rooter, the jetter guy says rooting doesn't work but they can be jetted and the plumbing contractor says neither of those will work they have to be replaced with plastic.I'm not expecting any trouble like this but forewarned is forearmed.

I tell him 1) None of the other tenants have any mold issues, nor have they ever, it's his responsibility to vent the room and clean the walls. and 2) I'll have someone come out and inspect it.
