My lease agreement states: "Abandonment" occurs when all of the following occur:(a) all occupants have vacated the Premises, in Landlord's reasonable judgment; (b) Tenant is in breach of this lease by not timely paying rent; and(c) Landlord has delivered written notice to Tenant, by affixing it to the inside of the main entry door or if Landlord is prevented from entering the Premises, by affixing it to the outside of the main entry door, stating that Landlord considers the Premises abandoned, and Tenant fails to respond to the affixed notice by the time required in the notice, which will not be less than 2 days from the date the notice is affixed to the main entry door.I know its early to worry, but if I does not hear from tenant in the next 3 days can I treat the property as abandoned and serve the notice?

The lease states that tenant shall vacate premises on termination of the agreement unless;1) landlord and tenant have extended this agreement in writing or signed a new agreement; 2) mandated by local rent control law; or 3) landlord accepts rent from tenant, in which case a month to month tenancy shall be created which either party may terminate as specified in paragraph 2a2a states either party may terminate in writing with 30 says notice (paraphrased)Last May the tenant and I signed an agreement, rent increased 12.5% and the main verbiage is:Specifically, the Parties agree to extend the Lease as per Provision 2A/B “Month to month & Lease” The extension to run month to month beginning October 1, 2018 at a monthly rent of $XXXX and requires a 60 day notice on the part of either tenant or landlord in order to terminate the agreement.

I agree with Michael that your main goal should be to determine if the property can generate a good positive cashflow after running the numbers and taking into account any cap X costs that may be coming up such as a new roof or hot water tank.

The property clearly needs some work done, roof & windows being the main two, but we know going in that we would have 20-25k to but into the building without feeling like we bought into a mistake deal.
