Unless both loans are with the same bank, you would not usually receive a joint counter response as the lienholders don't really work together like that.

Here is my best attempt at explaining this… An accredited investor is a defined by the United States Securities & Exchange Commission as someone who makes a minimum of $200,000 ($300,000 if filing jointly) or has a net worth of 1 million dollars excluding personal residence.

The IRS says that for a 1031 exchange the same taxpayer on the title of your townhouse has to take title on the replacement property  If you and your wife file a joint tax return return than you're "one taxpayer" so it doesn't matter which one of you takes title.An LLC in just your names might be OK depending on the state you reside.

The one way that I have seen this done in the past is by holding title to the property as joint tenants in common.This will allow the same property to be treated as both investment property and a primary residence.
