Hey Kathy - Leases come with the land, so whatever they have structured into their current lease is what will transfer with the property, and you will have to honor that agreement.

What I’m seeing quite often these days is a provision in the PSA regarding the EMD which states it is to be delivered via wire transfer to the settlement agent by Xpm on Ydate or the contract is null and void.

If it doesn't cause them to call your loan alone transfer than that's the best way to keep your assets safe.

Every lender I see requires all partners to be guarantors or all above a certain ownership % are to be guarantors on the loan.
