It also has a student loan judgment lien against the property that I am sure I'll have to pay off to release the home to me upon his death even if I am named in the will to receive the home (without my name on deed by then).

I know the lender sometimes puts there own name to the deed to make sure collateral is in place as quickly as possible... and yes I agree not losing the deposit is critical for repeat business...
