You're looking at a judicial foreclosure with installment contracts in most states now to foreclose on the equitable interests that can be set by statute, like 10% and that can be difficult to arrive at if it is not clearly stated in the statute, is it the contract price or is the buyer entitled to appreciation as in a future sale?

Currently we are having a difficult time obtaining all the disclosure forms from the HOA and after further looking into the issue we discovered that the HOA although is “operational” in terms of collecting the condo fees, cleaning the common areas, etc.they are not following all the legal formality of a HOA in regards of being incorporated, filling all the paperwork with the state.

Theoretically, I could have made the offer under an LLC name that didn't yet exist, with the expectation of getting it formally created before I had to prove it.
