From what I understand, best practice in Chicago (which has an extremely pro-tenant system of laws) is to have the tenant sign an acknowledgement saying that the Lessor has disclosed any code violations.

Figure out what lease options are practical for you given your resources and offer those, ie, if it's not practical for you to offer a build-to-suit, then don't.Like William mentioned, being comfortable looking over financials will be key in figuring out whether to lease or not.
