Personally, I don't know enough about her to have an opinion of whether she's smart or qualified, but these rumors of embezzling campaign funds are definitely troubling, and if there is evidence to support your implications, she should certainly be prosecuted...In some states it's perfectly legal to immediately start a new campaign and pay yourself a salary from the excess campaign funds of a previous campaign.

Make payment to them contingent on their being out by x date (I would go for 2 weeks) and the property to be "broom swept" clean, free from any excessive damage etc.If you can do it this way you are more likely to get your property sooner and in better condition and for a lower cost then going the legal route.
