You have a duty to be efficient, otherwise he could claim that it took 73+ days to rent simply because you dragged your feet after receiving his move out notice.Read your own lease, and if the tenant is required by your lease to cover the costs, I would inform the tenant, also in writing, that you "accept the offer of 2 months rent, in advance, as escrow for breach", and that "tenant shall be responsible for any additional re-rental costs; tenant shall receive a pro-rated refund if the unit is re-rented in less than 2 months."

@Lena Claybon - I agree with the other posts about JV or finding private capital, but will also offer another option that may or may not work for your situation.Not sure how close you are with your GC/contractors, but if you have a good relationship, you can have them agree to payment terms where they receive payment after each check-in draw with your lender (so I would assume a week or two later than typically expected).

However, if you have rental properties or running a side business then the small deductions like uniform, etc add up especially for officers since they don’t receive uniform allowance.
