If the tenant fails to perform, the landlord can terminate the agreement and keep the deposit as damages and move on finding another tenantIf you accept a security deposit and /or execute a lease for a future date and the tenant fails to perform at move in, your only option is to evict as there is a lease in place.

@Joshua Sclafani - The LLC will only act as a protective wall for you if the properties are also owned by the LLC and the rental agreement are with the LLC.

You are required to disclose, as well as use the registered name on all marketing material related to brokerage services, you may also want to have in writing a policy or agreement with your broker regarding compensation related to your wholesaling activity, I think you are getting into some difficult practices, be sure to have your ducks in a row
