thanks Tom well i think the LLC is waiting it out and milking it, the home is definitely worth more than what I owe in mortgage so the LLC is sitting pretty for right now, I just need this situation done so that I can get back on track..

My thoughts: If you plan to keep the place that long and having an extra $100 cash flow isn't critical to you, 15 is the way to go, if you just want to milk the home for what you can and ditch it, 30 year loan would be better. 

And then put down the eviction process so he realizes he can't just milk it for the entire month.

Either the deal works or it doesn't, and it has nothing to do with these "milk rules".Do the math.
