Doesn't sound like this is an actual listing agreement, rather an agent went to a listing appointment and offered to buy the property directly from the owner rather than list it for them.

I am also curious as to what your conversion rates are- how many calls it takes you to get a listing appointment, how many appointments it takes for you convert into an actual listing, customer cost, etc., and whatever important info you would like to share.
