In Texas lanldords must allow early termination of a lease in the case of domestic violence.The requirements are pretty straight forward, in that any tenant with a court-ordered restraint and police report for a domestic abuse/violence issue can leave without penalty.Usually, but not always, the court order will mandate who stays, who goes, and who's responsible for the lease.

As you dig a little deeper into the actual release by the provincial government the regulation only applies to licensed agents and appears to be "self-policing" by the industry itself ... so it may amount to a little more discretion, but not elimination of the behaviour.

In the event that it went to court wouldn't a "holding deposit" be considered an earnest money deposit, regardless of wording, in which case it couldn't be completely non refundable?

Maybe the wholesalers have the right idea and the direct marketing approach is the wiser path - to create deals instead of waiting for them to appear.
